Account Agreement
Do not use this web-based software application, RACER Data Analysis Tool (DAT),
until you have carefully read the following Agreement. This Agreement sets forth
the terms and conditions for licensing of the software from Risk Assessment Corporation (RAC)
to you (“you” or “Licensor”), and using the software indicates
that you have read and understand this Agreement and accept its terms and conditions.
If you do not agree with the terms and conditions of this Agreement, promptly notify
RAC and you will be prohibited from using this application.
Disclaimer of Warranties
EXCEPT AS PROVIDED ABOVE, THIS SOFTWARE, CONTENT, AND/OR ANY RELATED SERVICES ARE
PROVIDED “AS-IS,” AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE
LAW, RAC AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, PARTICIAPTING FINANCIAL INSTIUTUTIONS,
THIRD-PARTY CONTENT PROVIDERS, DISTRIBUTORS, DEALERS OR SUPPLIERS (“REPRESENTATIVES”)
DISCLAIMS ALL OTHER REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, REGARDING
THIS WEB-BASED SOFTWARE APPLICATION, RELATED MATERIALS AND ANY SERVICES, INCLUDING
THEIR FITNESS FOR A PARTICULAR PURPOSE, THEIR QUALITY, THEIR MERCHANTABILITY, OR
THEIR NONINFRINGEMENT. RAC DOES NOT WARRANT THAT THE SOFTWARE IS FREE FROM BUGS,
VIRUSES, ERRORS, OR OTHER PROGRAM LIMITATIONS, INCLUDING BUT NOT LIMITED TO ACCURACY
OF THIRD-PARTY CONTENT.
RAC obtains data from sources including the New Mexico Environment Department and
Los Alamos National Labs which is thereby provided to approved users via THE SOFTWARE.
Unless otherwise specified in writing, verification of the authenticity or accuracy
of this information is not warranted by RAC. The information contained and provided
via the SOFTWARE must only be utilized by the intended and approved client or recipient
and any other use is strictly prohibited.
Limitation of Liability and Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RAC AND ITS REPRESENTATIVES ARE
NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR OTHER DAMAGES
LICENSE
Permission is hereby granted, free of charge, to any person obtaining a copy of
this software and associated documentation files (the "Software"), to
deal in the Software without restriction, including without limitation the rights
to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies
of the Software, and to permit persons to whom the Software is furnished to do so,
subject to the following conditions:
The above copyright notice and this permission notice shall be included in all copies
of this Software or works derived from this Software.
